1. Acceptance of Terms

By accessing or using AI Journal ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Deniz Erginos, Hauptstr 37, 76872 Steinweiler, Germany, operating as AI Journal.

2. Description of Service

AI Journal is a personal journaling application that provides AI-powered features including:

  • Voice-First Journaling: Speech-to-text transcription with AI-powered text cleanup and structuring.
  • AI-Powered Insights: Monthly recaps, theme detection, emotional pattern analysis, and personalized growth suggestions.
  • Mood Tracking: Simple three-level mood system (Bad, Neutral, Good) with color-coded calendar visualization.
  • Calendar View: Month-at-a-glance visualization with color-coded daily mood display.
  • Streak Tracking: Journaling consistency tracking and daily prompt support.
  • Privacy-First Storage: Local-first storage with optional cloud synchronization via Google Firestore, Google Drive, or Apple iCloud, protected by end-to-end encryption.
  • Offline Mode: Full offline journaling capability with automatic sync when reconnected.
  • Biometric Security: Fingerprint authentication with PIN fallback to protect app access.
  • Data Export: Full export of all journal entries and personal data at any time.
  • API Cost Transparency: Per-feature cost tracking for AI-powered features using API credits.

The Service is available as a mobile application (Android, with iOS coming soon) and through our website.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. User Accounts

To use certain features of the Service, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Providing accurate and complete information when creating your account.
  • Notifying us immediately of any unauthorized use of your account.

You must be at least 16 years of age to create an account and use the Service.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Upload or transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable.
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Use the Service for any commercial purpose without our express written consent.
  • Reverse engineer, decompile, or disassemble any portion of the Service.
  • Use automated scripts, bots, or scraping tools to access the Service.

5. Your Content

You retain all rights to the content you create using AI Journal, including journal entries, voice recordings, mood data, and any other personal content ("Your Content"). By using the Service, you grant us a limited license to process Your Content solely for the purpose of providing and improving the Service, including:

  • Transcribing voice recordings into text via third-party AI services.
  • Cleaning, structuring, and enhancing journal entries using AI.
  • Generating AI-powered insights, theme detection, and monthly recaps.
  • Synchronizing data to your chosen cloud storage backend (Firestore, Google Drive, or iCloud), if enabled.

We do not claim ownership over Your Content. You may export or delete Your Content at any time using the app's built-in data export feature. Upon account deletion, we will remove Your Content from our servers within 30 days, except where retention is required by law. Locally stored content remains on your device and is under your control.

6. Intellectual Property

The Service, including its original content (excluding Your Content), features, functionality, design, and underlying technology, is and remains the exclusive property of AI Journal and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

The AI Journal name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of AI Journal. You may not use such marks without our prior written permission.

7. AI-Generated Content & API Credits

The Service uses artificial intelligence (via third-party AI models through OpenRouter) to generate insights, recaps, theme detection, emotional pattern analysis, and suggestions based on your journal entries. AI is also used for voice-to-text transcription and entry text cleanup. AI-generated content is provided for informational and reflective purposes only. It is not a substitute for professional advice, including but not limited to medical, psychological, or therapeutic guidance.

We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content. You are solely responsible for how you interpret and act on AI-generated insights.

AI-powered features consume API credits. AI Journal provides full cost transparency through a built-in cost tracking feature, showing you exactly what each AI operation costs. Core journaling features (writing, reading, mood tracking) are free and do not require API credits.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not warrant that the results obtained from use of the Service will be accurate or reliable.

AI Journal is a journaling and self-reflection tool. It is NOT a medical device, therapy substitute, or clinical tool. If you are experiencing mental health difficulties, please consult a qualified healthcare professional.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AI JOURNAL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY EUROS (EUR 50), WHICHEVER IS GREATER.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by deleting your account through the Service settings or by contacting us. Upon termination, your right to use the Service will cease immediately.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Germany.

If you are a consumer in the European Union, you also enjoy the protection of the mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.
